When You Need This Contract
Research project SOWs must define the research questions, methodology, data collection approach, analysis framework, and deliverable format with precision. The SOW should address participant recruitment and consent management for primary research, data protection for personal data collected, intellectual property ownership of research findings and datasets, and the important caveat that research findings cannot be guaranteed to support any particular hypothesis or business decision.

Who owns research data and findings?
The SOW should assign ownership of the final research report and findings to the client. Raw research data ownership should also be addressed: typically the client owns the dataset, but the researcher may retain anonymised data for academic or benchmarking purposes if agreed. Participant consent forms must cover the client's intended use of the data. The researcher should retain the right to reference the methodology for professional purposes.
What GDPR obligations apply to research projects?
If the research involves collecting personal data from participants, GDPR applies in full. The SOW must address the lawful basis for processing, typically consent, what participants are told about data use, how consent is obtained and recorded, data storage and security measures, retention periods, and participant rights including the right to withdraw. Include a data protection impact assessment for sensitive research topics.
